These terms govern your use of the Koncur mobile app and the koncur.app website (together, "Koncur"). By creating an account or using Koncur, you agree to these terms. If you don't agree, don't use Koncur.

Plain version: Koncur gives you an AI-coached training programme. The app is informational and does not replace medical or coaching advice. You're responsible for training within your physical capacity. Subscriptions auto-renew until you cancel. You can delete your account in-app at any time.

1. Who provides Koncur

Koncur is operated by Alex Bigby (sole trader, United Kingdom). Contact: hello@koncur.app.

2. What Koncur is — and isn't

Koncur generates a personalised training programme using a deterministic engine plus an AI Coach. It uses heart rate, recovery metrics, GPS, and your logged sessions to adapt the programme over time.

Koncur is not medical advice. The Coach, programme engine, recovery score, and training-load model are educational and informational. They are not diagnostic, not treatment, and not a substitute for advice from a qualified medical professional or in-person coach. If you have a medical condition, are pregnant, recovering from injury, or have any reason to be cautious about exercise, consult a doctor before using Koncur.

3. Training risk & your responsibility

Strength training, running, and aerobic exercise carry inherent risk of injury. By using Koncur you acknowledge:

You are physically able to undertake the training prescribed.
You'll warm up appropriately and stop if you feel pain or unusual fatigue.
You won't push through symptoms you should investigate (chest pain, dizziness, sharp joint pain, etc.).
Loads, RPE targets, and zone prescriptions are guidance; you're the final judge of whether to lift a given weight or hit a given pace today.
You assume the risk of any injury arising from training. To the maximum extent permitted by law, Koncur is not liable for injury, loss, or damages arising from your use of the app's prescriptions or the Coach's advice.

4. Account & eligibility

You must be at least 16 years old to use Koncur.
You're responsible for keeping your account credentials secure.
You're responsible for the accuracy of profile data you enter (height, weight, age, sex). The engine's prescriptions only work as well as the inputs.
One account per person. Sharing accounts breaks the load-tracking model.

5. Subscriptions & billing

Pricing & auto-renewal

Monthly

£14.99 per month, auto-renewing every month until cancelled.

Annual

£119 per year, auto-renewing every year until cancelled.

Free trial

If offered, the free trial converts to the chosen paid plan at the end of the trial period unless you cancel at least 24 hours before the trial ends.

How billing works

Subscriptions are billed by Apple via your App Store account.
Payment is charged at confirmation of purchase.
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
Your account is charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel subscriptions in iOS Settings → [your name] → Subscriptions, or via the App Store app.

Refunds

All refunds are processed by Apple, not Koncur. Apple's refund policy applies; you can request a refund at reportaproblem.apple.com. We don't have the ability to issue refunds outside of Apple.

Brand transition (FXV Performance → Koncur)

Koncur is the rebrand of FXV Performance. If your subscription was purchased under "FXV Performance", it carries over unchanged through the rename — the underlying Apple subscription, billing cycle, and renewal price are identical. Apple receipts may continue to display "FXV Performance" for a period; this does not affect your access or rights.

6. Use of the AI Coach

The Coach feature uses Anthropic's Claude model. By interacting with the Coach you accept that:

Coach output is generated by an AI model and may occasionally be inaccurate, incomplete, or out of date.
Coach is not a doctor, physiotherapist, registered dietitian, or licensed coach. Treat its replies as input, not instruction.
You should not share information through Coach that you would not want logged on our servers (see Privacy Policy).
If Coach proposes a programme adjustment, you can accept, undo, or ignore it; the choice is yours.

7. Acceptable use

You agree not to:

Reverse-engineer, disassemble, or attempt to extract source code from the app.
Scrape, copy, or republish the programme generation logic, exercise database, or Coach prompts.
Use Koncur to harm yourself or others, or in violation of any law.
Use automated tools or fake data to manipulate the programme engine.
Interfere with the operation of Koncur's servers or other users' accounts.

8. Intellectual property

The Koncur brand, mark, app design, programme generation engine, exercise database, and Coach prompts are owned by Koncur. You get a non-exclusive, non-transferable, revocable licence to use Koncur for personal, non-commercial training. You don't get any rights to Koncur's IP beyond that licence.

The data you log (sets, reps, RPE, sessions) is yours. We use it to operate Koncur for you, never to train AI models, never sold.

9. Termination

By you

You can stop using Koncur at any time:

Cancel your subscription in iOS Settings (above).
Delete your account in-app: Profile → "Delete account". This permanently erases your data within 30 days.

By us

We may suspend or terminate your account for serious or repeated breach of these terms (e.g. abuse, fraud, attempting to harm other users or the service). We'll give you reasonable notice when feasible. If we terminate without cause, you'll receive a pro-rata refund of any prepaid subscription fees, processed via Apple.

10. Disclaimer of warranties

Koncur is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties — fitness for purpose, merchantability, accuracy, uninterrupted availability — and make no guarantee that Koncur will meet your training goals.

11. Limitation of liability

To the maximum extent permitted by law, Koncur's total liability to you for any claim arising out of these terms or your use of Koncur is limited to the amount you paid us in the 12 months preceding the claim. We're not liable for indirect, incidental, consequential, or punitive damages — including but not limited to loss of fitness gains, missed training, or injury arising from prescription or Coach output.

Nothing in these terms limits liability for fraud, gross negligence, or any liability that cannot lawfully be excluded under UK law.

12. Changes to these terms

We may update these terms occasionally. If a change is material, we'll notify you in the app before it takes effect. Continued use of Koncur after a change means you accept the updated terms.

13. Governing law & disputes

These terms are governed by the laws of England and Wales. Disputes that cannot be resolved by writing to hello@koncur.app are subject to the exclusive jurisdiction of the courts of England and Wales, except where you have non-waivable consumer rights to bring proceedings in your country of residence.
